Terms of Service
Last updated: 11 October 2026
These terms apply when you use the AI Warehouse website (aiwarehouse.com.au), send us an enquiry, accept a quote or buy products from us. "AI Warehouse", "we", "us" and "our" means AI Warehouse (ABN 40 466 852 258), Victoria, Australia. "You" means the person or organisation using the website or buying from us.
By using the website or placing an order you agree to these terms. Please read them with our Refund Policy, Shipping Policy and Privacy Policy, which form part of them.
1. Your rights under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where these terms limit our liability, they do so only to the extent the law allows.
2. How buying works
- Enquiries. Adding products to an enquiry and sending it to us is a request for a quote. It is not an order and does not commit you or us to anything.
- Quotes. We reply with a quote confirming availability, price and delivery. A quote is valid for the period stated on it, or for 7 days if no period is stated.
- Orders. A contract is formed only when you accept our quote, we confirm your order in writing and payment has been received as set out in the quote or invoice.
- Our right to decline. We may decline or cancel an order before dispatch, for example if a product becomes unavailable, a price or description was wrong, or we cannot complete the checks described in section 4. If we cancel after you have paid, we refund what you paid in full.
3. Prices and payment
- Prices are in Australian dollars and include GST unless stated otherwise.
- Prices shown on the website are list prices and can change without notice. The price that applies to an order is the one in the quote you accept.
- If a price on the website or in a quote is clearly wrong because of an error, we will tell you before dispatch and you can accept the correct price or cancel for a full refund.
- Payment is due as set out on your invoice. We issue a tax invoice for every order.
- Ownership of goods passes to you when we receive payment in full.
4. Export controls and end use
Some products we sell, including certain GPUs and AI computing systems, are subject to Australian and foreign export control laws, including United States export regulations. Before we complete a sale we may ask you to complete an export compliance or end-use declaration and to give us information about yourself, your organisation and how the products will be used.
By buying from us you agree that you will:
- give us accurate and complete information in any declaration or check;
- comply with all export control and sanctions laws that apply to the products; and
- not export, re-export or transfer the products, or use them, in breach of those laws.
We may decline or cancel any order where we cannot complete these checks, or where we reasonably believe a sale would breach those laws. To the extent the law allows, you are responsible for any loss we suffer because information you gave us was false or because you breached this section.
5. Product information
Product descriptions, specifications and images come from manufacturers and our distributor. We take care to keep them accurate, but manufacturers change specifications and packaging from time to time, and images are for illustration. If anything matters to your decision, such as compatibility, power, dimensions or included accessories, please confirm it with us before you order.
Stock labels such as "In stock" and "Available to order" are a guide only and are confirmed in our quote.
6. Guides, resources and consultations
Our guides, solution pages, resource links and consultations are general information to help you think about your needs. They are not professional, engineering or technical advice for your particular situation. You are responsible for deciding whether a product suits your purpose, including its compatibility with your existing systems, software and power supply.
Links to third-party websites, software, models and documentation are provided for convenience. We do not control or support them and are not responsible for their content, availability or licences, or for how they work with your equipment. Open-source and open-weight AI models carry their own licences, which you are responsible for complying with.
7. Limitation of liability
Subject to section 1, and to the extent permitted by law:
- Where goods are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for failing to comply with a consumer guarantee is limited, at our option, to replacing the goods or supplying equivalent goods, repairing the goods, or paying the cost of doing so.
- We are not liable for any indirect or consequential loss, including loss of profit, revenue, business, data or opportunity, arising from your use of the website or the products, except where that loss was reasonably foreseeable and results from our failure to comply with a consumer guarantee.
- Our total liability to you for any claim arising from an order is limited to the amount you paid us for the products that gave rise to the claim.
You are responsible for backing up your data and software before installing, connecting or servicing any product.
8. Warranty
Products carry the manufacturer's warranty, which applies in addition to your rights under the Australian Consumer Law. Warranty terms vary by manufacturer and product; we will tell you the term on request. Please contact us first with any warranty issue and we will manage the claim with our distributor and the manufacturer for you. Our Refund Policy explains how faults and damage are handled.
9. Using this website
- You must not use the website for anything unlawful, or try to interfere with its security or operation.
- Content on this website, other than manufacturer material and trade marks, belongs to AI Warehouse. Product names, brands and logos belong to their owners, and their use does not mean those owners endorse us.
- We do our best to keep the website available and accurate, but we do not promise it will always be available or free of errors.
10. Changes to these terms
We may update these terms from time to time by posting a new version on this page. The terms in force when you accept a quote apply to that order.
11. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
